§1 General ProvisionsThis Privacy Policy defines the rules for the processing and protection of personal data provided by users in connection with their use of the website https://povaliaieva-consult.tilda.ws/ and other related websites.
Personal data of users is processed in accordance with the applicable legal provisions, i.e. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR).
§2 DefinitionsFor the purposes of this Privacy Policy, the following definitions apply:
  • Data Controller / Controller – Tetiana Povaliaieva.
  • Cookies – IT data stored on Users’ end devices, intended for use on websites.
  • Personal Data – any information relating to an identified or identifiable natural person, in particular by reference to such an identifier as a name, surname, address, e-mail address, telephone number.
  • Privacy Policy – this Privacy Policy.
  • GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.
  • Service – the website available at https://povaliaieva-consult.tilda.ws/ and other related websites.
  • Users – all persons using the website https://povaliaieva-consult.tilda.ws/ and other related websites.
  • Contractor – a craftsman cooperating with the Service.
  • Request for Contact with Contractor – a User’s declaration of intent submitted via the Service (by phone or through the Order Form), directly aimed at obtaining the Contractor’s contact details to deliver a service offered by the Contractor.

§5 Purposes, Legal Basis and Duration of Processing of Personal DataUsers’ Personal Data will be processed for the following purposes:
  1. Marketing of the Controller’s products – based on Art. 6(1)(a) GDPR, until consent is withdrawn.
  2. Execution of a Request for Contact with a Contractor – based on Art. 6(1)(b) GDPR, for the duration of the agreement, and thereafter for the time necessary to handle complaints, safeguard or pursue possible claims, as required by law.
  3. Provision of electronic services by the Controller (Order Form) – based on Art. 6(1)(b) GDPR, for the duration of the service, and thereafter for the time necessary to handle complaints, safeguard or pursue possible claims, as required by law.
  4. Compliance with legal obligations incumbent on the Controller, e.g. accounting, tax regulations – based on Art. 6(1)(c) GDPR, until such obligations are fulfilled.
  5. Pursuing the legitimate interests of the Controller – based on Art. 6(1)(f) GDPR, such as:
  6. a) handling requests (e.g. complaints related to electronic services) or responding to questions sent to the Controller – for the period necessary as required by law;
  7. b) pursuing or safeguarding claims – for the period required by applicable law.
§6 Provision of Personal DataProviding Personal Data is voluntary but contractually required. Failure to provide Personal Data may result in the inability to fulfill a Request for Contact with a Contractor.
§7 Categories of Recipients of Personal DataUsers’ Personal Data may be disclosed to Contractors, employees and associates of the Controller, hosting and IT service providers, subcontractors, business partners of the Controller, and employees or associates of such entities.
The Controller may also process the Personal Data of Users visiting the Controller’s social media pages (Facebook, Instagram, Pinterest), including those engaging with these profiles. These websites operate independently of the Service and are not monitored by it. They may have their own privacy policies, which Users are advised to review.
§8 Transfer of Personal Data to Third Countries or International OrganizationsIf Users’ Personal Data is transferred to third countries (outside the EEA), it will be only to entities providing adequate safeguards and ensuring the rights of data subjects. For example, the Controller may use IT service providers based outside the EEA. In every case, data transfers will be based on applicable law and standard contractual clauses adopted by the European Commission. A copy of such data may be obtained upon request to the Controller.
§9 Rights of UsersUsers have the right to access their Personal Data, rectify it, delete it, restrict its processing, transfer it, object to processing, and withdraw consent at any time if processing is based on consent. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.
Users have the right to lodge a complaint with the President of the Personal Data Protection Office if they believe their Personal Data is being processed unlawfully.
§10 ProfilingUsers’ Personal Data may be subject to profiling.
Profiling involves automated analysis or prediction of a User’s behavior on the Service, e.g. analyzing submitted Requests for Contact.
As a result, the User may receive personalized Service offers. The decision to act on such notifications lies solely with the User.
  1. §11 Cookies PolicyCookies are IT data stored on Users’ end devices, primarily text files containing the website name, storage duration, and unique identifier.
  2. The Service does not automatically collect information other than that contained in Cookies.
  3. The Controller uses Cookies to:
  • adapt website content to Users’ preferences (Cookies recognize the device and display the site accordingly);
  • create anonymous statistics, excluding User identification.
  1. Cookies used by Service partners are subject to their own privacy policies.
  2. Cookie settings can be adjusted in each browser, up to complete blocking. This increases security but may prevent the use of some functionalities.

§12 Final ProvisionsThe Controller reserves the right to amend this Privacy Policy for important reasons, particularly: changes in the law or in the Service’s functionalities – insofar as they affect the implementation of this Policy. Users will be notified of changes at least 14 days in advance by an appropriate notice published on the Service website.
